Research facility - Recognition by the BAMF
All research facilities, who want to employ foreign scientists, have to be previously recognized by the Bundesamt für Migration und Flüchtlinge (BAMF).
Only after recognition may research facilities conclude employment contracts with foreign scientists.
Note: Companies engaged in research are also called "Research Facilities".
the Bundesamt für Migration und Flüchtlinge (BAMF)
The facilities have to
- be engaged in research and
- be in a position to bear all costs which arise from the hosting agreement.
To have your research facility recognised by the BAMF, you have to file an application in writing.
The research facilities are obliged to assume all the costs for a period of six months which arise if a scientist stays in one of the member states of the European Union (EU) without permission after expiry of his/her residence permit.
Facilities, which are mainly financed from public funds, do not have to submit a declaration that they will assume the costs. The same applies for research projects for which there is a particular public interest. You can find more details in the form and also in the leaflet for the assessment application which the BAMF offers as a download on its website.
After your application has been positively checked, the BAMF recognizes the research facility and lists it in a list of the recognised research facilities (Liste der anerkannten Forschungseinrichtungen).
The research facility recognised by the BAMF may then conclude hosting agreements with the researchers.
The research facility passes on the concluded hosting agreement to the responsible authority for foreign nationals (to grant the residence permit) or German Embassy/Consulate (to grant a visa).
A list of the required documents can be found in the application for recognition as a research facility.
Normally a recognition as a research facility is valid for five years. A renewal is possible.
Further information on the recognition procedure can be found on the BAMF website.
The researchers, with whom you conclude the hosting agreements, can then apply for residence for research purposes.
There is a charge of 200 euros for the recognition of a research facility, whose activities are not mainly financed from public funds.
